NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING
1. SPONSOR: The Maya Group, 7312 Murdy Circle Huntington Beach, CA 92647 solely responsible for all aspects of this Contest (“Contest”).
2. ENTRY: During the period commencing at 5:00 P.M. Pacific Daylight Time (PDT) on September 14, and ending at 11:59:59 P.M., PDT October 5, 2010 (“Entry Period”), Sponsor invites you to enter the Contest by submitting one (1) original digital photo of an Orbeez design using the Orbeez Play ‘n Display Tray. Entries must be e-mailed to: info@orbeezone.com.
Entry Steps:
1) Create an Orbeez design using Orbeez of any color and your Play ‘n Display Tray
2) Take a digital photo of the design. (Do not include any personal information in the photo, including faces, names or address).
3) Have your parent or legal guardian submit the digital image as a .gif or .jpeg (no more than 1 MB) to info@orbeezone.com
4) Have your parent or guardian include the following:
a. Parent or guardian’s first name
b. Parent or guardian’s email address
c. Entrant’s first name (entrant must be between the ages of 5-15)
d. Image of Orbeez design included as a .gif or .jpeg
For purposes of these Official Rules (“Rules”), all times and days are Pacific Daylight Time.
3. LIMITATIONS: All Entries must be received by 11:59:59 P.M., October 5, 2010. You may enter the Contest no more than once per day. Entries by any method other than set forth above in Section 2 are void. Open only to parents or legal guardians of children ages 5 through 15 who submit the entries on behalf of their children and who are legal residents of, and physically located within, the 50 states, D.C., and not employees of Sponsor, its parent, subsidiary, affiliate, or agency (individually and collectively, “Entities”), nor members of their households or immediate families. Neither the Entities nor any of their officers, directors, shareholders, employees, agents, or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; or Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, provincial, local and municipal laws and regulations.
4. PRIZES: Five (5) PRIZES (one for each winner). Grand Prize: one (1) Orbeez Magic Maker (ARV: $25 each). Second Prize: one (1) Orbeez Flow ‘n Show (ARV: $20 each) Third Prize: one (1) Orbeez Stack ‘Ems (ARV: $15 each). Fourth Prize: one (1) Orbeez Butterfly (ARV: $12 each). Fifth Prize: one (1) Orbeez Peace Sign (ARV: $12 each). Total ARV of all prizes: $84. ARV is defined as “Approximate Retail Value.”
Limit one prize per family. Any depiction of prize is for illustrative purposes only. Prizes are not redeemable for cash or transferable. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. The prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in the Rules is available to be won. All prizes will be awarded provided a sufficient number of eligible Entries are received and prizes validly claimed by January 1, 2011, after which no alternate winners will be selected, nor unclaimed prizes awarded.
5. PROCEDURES: Entries will only be accepted during the Entry Period. During the Entry Period, from time to time at various times to be determined solely at the sponsor’s discretion, potential winners will be selected at the discretion of The Maya Group from eligible Entries received.
6. WINNERS: On or about October 12, 2010, potential winners will be notified by e-mail using the address provided. In order to be declared a winner, you must meet the eligibility and forfeiture provisions of these Rules. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to notification within three (3) days after its transmission; [2] the return of an e-mail notification as undeliverable after three (3) attempts; [3] Potential winner’s failure to a return a release and consent form within five (5) days of email [4] the return of any prize as undeliverable; [5] potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; [6] potential winner’s failure to claim a prize within ten (10) days after it is sent; [7] potential winner’s failure to validly claim any prize by January 1, 2011 and [8] any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of each winner.

8. CONDITIONS: By entering this Contest and/or accepting any prize you may win, you agree, represent and warrant that: [1] you will be bound by the Rules and Sponsor’s decisions, which shall be final in all respects; [2] the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned; [3] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the Entry; awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Contest or any Contest-related activity or travel or from any interaction with, or downloading of, computer Contest information; [4] the prizes are awarded “A S IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); [5] winner’s acceptance of any prize constitutes the grant of an unconditional right to Sponsor and assigns to use winner’s first name, address prize information, contest submission and/or statements about the promotion for any publicity, advertising, and promotional purposes without additional compensation, except where prohibited by law; [6] in the event viruses, bugs, unauthorized human intervention, acts or regulations of any governmental or supranational authority, Acts of God, war, national emergency, accident, fire, riot, strikes, lockouts, industrial disputes, acts of terrorism, or other matters beyond the Sponsor’s reasonable control, corrupt, prevent, or impair the administration, security, fairness or proper play of this Contest, so that it cannot be conducted as originally planned, the Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate, or suspend the Contest, and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [8] the Releasees are not responsible for any inability of any winner to accept or use any prize for any reason and [9] Sponsor has the right to modify prize award procedures at its sole discretion.
